Proposed Comprehensive Plan amendment Urban Growth Boundary Expansion
NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Hermiston Planning Commission will hold a public hearing on the 13th Day of August, 2025 in the council chambers of the Hermiston City Hall, 180 NE 2nd Street, Hermiston, Oregon at 7:00 pm. The purpose of the hearing is to consider amending the City of Hermiston comprehensive plan to add approximately 810 acres of land to the Hermiston Urban Growth Boundary (UGB).
The land proposed to be added to the UGB and City limits (the “Territory”) consists of three tracts located on south of Feedville Road between Ott Road and Highway 207. The properties within the Territory are identified as 4N 28 21D Tax Lot 800, 4N 28 28A Tax Lot 100, 4N 28 27 Tax Lots 200, 500, 600, and 700, and 4N 28 1700, 1800,1900, and 2500. Only those portions of 4N 28 Tax Lots 1700 and 2500 located north of the centerline of the Feed Canal are included within the Territory.
The City proposes to add the Territory to the Hermiston UGB and City Limits to provide land for industrial development consistent with the adopted 2024 Hermiston Economic Opportunities Analysis.
The UGB expansion consists of multiple legislative revisions to the Comprehensive Plan and zoning code, and annexation of the Territory to the City of Hermiston. Rights-of-way for Feedville Road are also proposed for inclusion with the Territory.
The proposed amendments are described below:
- Amendment to the City of Hermiston and Umatilla County Comprehensive Plan maps to designate the Territory as “Industrial” on the Hermiston Comprehensive Plan Map.
- Amendment of the Hermiston Public Facilities Plan to address the provision of public facilities to the Territory.
- Amendment to the Hermiston Zoning Ordinance (City Code Title XV, Chapter 157) adding section 157.058, the “Hyperscale Data Center (HDC) Overlay.”
- Annexation of the subject property to the City of Hermiston and withdrawal from the Umatilla County Special Library District with the zoning designation of Heavy Industrial (M-2) with a HDC Overlay.
The criteria that are applicable to the decision are:
- Statewide Planning Goals 1, 2, 9, and 11–13.
- OAR 660, Division 24, Sections 0040—0067.
- OAR 660, Division 11.
- Comprehensive Plan Policies 1, 2, 3, 4, 5, and 6.
- City Code Sections 150.05, 156.08, and 157.226.
- ORS 222.111–175.
The Planning Commission will make a recommendation to the City Council to approve or disapprove the proposed amendments. The City Council will hold a public hearing on the proposed amendments on August 25, 2025 at 7:00 p.m. in the Council Chambers.
The proposed amendments must also be reviewed and adopted by Umatilla County. Notice of the public hearings before the Umatilla County Planning Commission and Board of Commissioners shall be by separate notice following adoption by the City of Hermiston.
The public hearings will begin with the staff report. This will be followed by public testimony. The public hearing portion will then be closed, and the City Planning Commission will consider the information and testimony received and will make a recommendation to the City Council. Persons may testify in person at the hearing or submit written testimony before or during the hearing. Written testimony should be directed to Clint Spencer, 180 NE 2nd Street, Hermiston, Oregon, or delivered in hard copy at the hearing.
FAILURE TO RAISE AN ISSUE ACCOMPANIED BY STATEMENTS OR EVIDENCE SUFFICIENT TO AFFORD THE DECISION MAKERS AND THE PARTIES AN OPPORTUNITY TO RESPOND TO THE ISSUE PRECLUDES APPEAL TO THE LAND USE BOARD OF APPEALS BASED UPON THAT ISSUE.
A copy of the application, all documents and evidence submitted by or on behalf of the applicant, and applicable criteria are available for inspection at no cost at the City of Hermiston Planning Department office Hermiston City Hall, 180 NE 2nd Street, Hermiston, Oregon 97838, and copies can be provided to interested persons at a reasonable cost. A staff report will be available for inspection at no cost at least seven days prior to the hearing and will be provided at a reasonable cost.
