Every defendant has the right and option to challenge their citation at trial.
Violation trials are held with the defendant (person cited), the Officer and the Judge. The Judge hears evidence and argument from both sides and decides whether the City (Officer) has proven the case by a preponderance of evidence. Jury trials are not held for violation cases. (ORS 153.076). Both parties (the defendant and the Officer) may call witnesses and present photo, video, or documents as evidence. Traffic/Violation trials usually take less than 30 minutes. You do not need an attorney for a traffic trial, but may hire one if you wish. An attorney will not be appointed to you for a traffic/violation matter.
